California employers continue to face many legal challenges. The California Fair Employment and Housing Council finalized two sets of regulations that went into effect on July 1 covering permissible use of criminal history information and transgender discrimination. Legalized marijuana is coming to California even though it is still prohibited under federal law, and many questions are arising about employers’ right to continue to maintain a drug-free workforce. A new court ruling requires that employees who are paid on commission must get separate compensation for their legally required rest periods. Leaves of absence continue to be a leading cause of employment lawsuits, and the California legislature is busy again this year writing even more legislation regulating employers.
